Terms and Conditions

These terms govern the use of The Freelancer Portal, operated by Oliva Advisory GmbH.

1. Scope

These terms apply to all contracts for the use of The Freelancer Portal between Oliva Advisory GmbH ("we") and the customer ("you"). The service is offered exclusively to entrepreneurs within the meaning of § 14 BGB, to legal entities under public law and to special funds under public law. It is not offered to consumers.

2. Formation of contract

A contract comes into effect when you register an account and we confirm activation. The presentation of the service on this website is not a binding offer.

3. Free trial

We offer a free trial of 14 days with full access to the selected plan. You provide a payment method when you register, but no payment is taken during the trial. Unless you cancel before the trial ends, the plan continues as a paid subscription and the first charge falls due when the trial period expires. If you cancel before it ends, you are not charged.

4. Services

The scope of the service follows the plan you select. We may develop and improve the service, provided the agreed functionality is not materially reduced during a paid term.

5. Prices and payment

Prices are stated per seat per month as a single gross figure and include statutory VAT at 19%. Billing is monthly and is taken from the payment method held on your account, beginning when the free trial ends.

Payments are processed by our payment provider, Stripe. The payment methods open to you are those Stripe makes available at checkout for your country, which include the major credit and debit cards. You enter your payment details with Stripe and they are held by Stripe; we do not store your full card data ourselves.

An invoice is issued electronically for each billing period. If a payment fails we may retry it, and where payment remains outstanding we may suspend access to the service until the balance is settled. The statutory rules on default and default interest apply.

6. Term and cancellation

The subscription runs on a monthly basis and renews automatically for a further month unless cancelled. There is no minimum term beyond the current month and no notice period.

You may cancel at any time from your account settings. Your subscription then stays active until the end of the billing period you have already paid for, and is not renewed after that. Cancelling does not refund the current month.

7. Your data and your clients' data

You remain the owner of all content and data you upload. Where that data contains personal data of your own clients or staff, you are the controller and we process it solely on your instructions under a separate data processing agreement pursuant to Art. 28 GDPR.

On termination you may export your data. We delete it 30 days after the contract ends, unless statutory retention obligations require otherwise.

8. Acceptable use

You may not use the service unlawfully, upload malicious code, attempt to gain unauthorised access, or use it in a way that impairs its operation for others. You are responsible for keeping your access credentials confidential.

9. Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Munich — which matches the registered seat and the register court, Amtsgericht München.
